Dr. Wine released from prison pending an appeal

The Third District Court of Appeals has ordered the release of St. Marys eye doctor Douglas Wine from prison pending the outcome of his appeal for a new trial.

In October of last year a jury found Wine not guilty of rape, but guilty of a lesser offense of gross sexual imposition.

On Dec. 14, 2011 Judge Frederick Pepple in Auglaize County Common Pleas Court ordered Wine to serve 15 months in prison, and at the same time denied a defense motion to postpone  the start of that prison sentence pending an appeal.
