The couple say they love their daughter, now 2 years old, but have fear about raising her in the predominantly white community of Uniontown, which is in northeast Ohio.
The lawsuit is seeking at least $50,000, which the couple’s attorney says will pay for ongoing family counseling.
Here are some responses from our online readers:
They didn't get what they paid for, simple. They want the clinic to institute some new computerized procedures, and it's not like they're suing for millions. They moved to make things more comfortable for their daughter, now it's time for the sperm bank that made the mistake to take responsibility and pay up to help them out. — MARIA KAUFLIN
They are suing to make sure the company doesn't make the same mistake. Yes this little girl deserves all the love in the world, my guess is, she'll get it. However if you go pay for something you should get what you paid for, that's that. — AMY JOHNSON
Wow! It's a human being. … They should just be thankful they were able to have a baby at all. — SHELBY LEWIS
I'd sue them too. Choosing a biological parent for your child is a very personal decision. This is not the type of mistake that should be taken lightly. — EMILY RETHERFORD
OK so these two women went to a sperm bank and chose a donor to best match the partner that was not carrying the baby so he/she would look as close to the partners as possible. The sperm bank messed up. I feel bad for the partner that has no biological connection. If this lawsuit had been centered around that instead of race, I feel there would be more compassion. I hope this baby lives a life full of love and does not mind standing out in a world where we are supposed to fit in. She is a gift and needs to know that. — KRISTINA RENEE
It shocks me once again to read people's views. How they are making this into a racial thing. Clearly the couple is NOT racial or they would have aborted as soon as they found out or adopted the child out. People take so many things into account when picking a donor … medical history being the most important. They have NO idea about anything of this donor's medical history alone … not to mention, so many other factors that are important when choosing. Just the fact that a clinic doing something so important as making a human being could be so irresponsible!! This is not about race why they are suing, it's about a place that is taking people's money and making promises with NO safeguards in place what so ever… — KIM LEFFLER GOTTHARDT
And someday they will have to explain to this little girl that they got lots of money to help make her "comfortable" because of the color of her skin … That's a conversation that will kill a lot of self-esteem. — KERI BROWN
(W)why shouldn't they sue? The reasons are their business. —DARRELL LESLIE
