Gray market goods are items manufactured abroad and imported into the U.S. without the consent of the trademark holder. Gray market goods are not counterfeits; however, differences may exist between these goods and those goods produced for American sale. Just about every kind of item for sale could be found on the gray market online — things like watches, TVs, books, DVDs, etc. Most of these items are sold through websites and online auctions.
When shopping for gray market goods, your Better Business Bureau offers these tips:
• Beware of brand name products being sold significantly below the manufacturer’s price. Consider the value of warranties and rebates you may be required to forgo.
• Ask the seller whether is he or she is selling gray market products. Sellers are obliged to disclose when a product isn’t covered under a valid warranty or eligible for any rebate offered by the manufacturer.
• Inspect the merchandise and make sure it works. Gray market goods may not be new. Make sure manual and other printed material are in English.
• Read the whole product description; including the fine print. It’s important to understand the product details to avoid surprises when it’s delivered.
• Keep order documentation.
• Read the return policy to see if the business allows a full refund if you’re unhappy with the product. Also, review the policy to see who pays for the cost of shipping and handling for the return.
• Ask about repairs. Merchandise most likely will not be eligible for repairs at a manufacturer’s authorized service center. Ask where it will be done and whether repairs will be performed according to the manufacturer’s specifications.
• Use a credit card for payment. A credit card allows you to dispute charges for the purchase of gray market merchandise that was misrepresented at the time of sale.
