Men sentenced to 10 years in prison in Kettering child rape case

Two men charged in connection to a juvenile sex assault case in Kettering were sentenced to serve 10 years each in prison.

Jason Purkey, 46, and Todd Marshall, 27, were convicted of charges of rape in the case. Purkey was sentenced in December and Marshall was sentenced Friday.

Montgomery County Prosecutor’s Office spokesman Greg Flannagan told the Dayton Daily News that there was one victim in the case who was assaulted by both defendants. Court records show Marshall pleaded guilty to 11 counts of rape (by force or threat of force) and one count of disseminating matter harmful to juveniles.

“Defendant will receive an agreed 10-year mandatory prison sentence,” a waiver and plea agreement says.

A statement of facts filed in Kettering Municipal Court says in connection to charges against Marshall says the crimes occurred between January 2015 and March 2019 at a Kettering home when the minor was 10 to 14 years old.

The victim is known to the suspects, according to the Montgomery County Prosecutor’s Office.

Court records also show Purkey pleaded guilty to five counts of rape (by force or threat of force), disseminating matter harmful of juveniles and having weapons while under disability.

Both men are still jailed at the Montgomery County Jail, according to records.
