On Jan. 26, two Dayton officers discharged their weapons, striking a Larry Black after that man had fired his weapon at the officers, according to a media release.
The suspect was charged with five counts of felonious assault and his case will be presented to the grand jury.
UPDATE @ 2:55 p.m. (Jan. 27):
Police were called after Larry D. Black, 61, fired one shot at his 30-year old son, Larry B. Black, Dayton Police Chief Richard Biehl said during a press conference this afternoon.
The elder Black fired a shot at police and they returned fire, Biehl said.
Officers tried unsuccessfully for three hours to get the 61-year-old man to come out of the house peacefully. They eventually entered the house and found the elder Black injured. He’d been shot in the arm.
He was taken to a local hospital for treatment and his being watched by armed guards, the chief said.
Prior to SWAT arrival, Black fired several shots inside the residence, Biehl said.
Black used a Smith & Wesson .40 caliber semi-automatic handgun in the shooting. A .12 gauge shotgun also was recovered in Black’s home, although it was not fired, Biehl said.
Black underwent psychiatric evaluation on Jan. 23 and released on Jan. 25, the chief said.
The Montgomery County Prosecutor has approved five counts of felonious assault with gun specification against Black, Biehl said.
Thirteen shell casing were discharged from the guns fired by the two officers involved in the shooting, the police chief said.
He said they have no indication the weapons recovered from Black’s home were stolen and they don’t know how he obtained them.
UPDATE @ 1:40 a.m.
Dayton police said a suspect was shot at least one time by officers during an exchange of gunfire between the man and police in a SWAT situation on Burbank Drive Thursday.
Officers were first dispatched to a home in the 1900 block of Burbank Drive around 7 p.m. on initial reports of a domestic situation where a father fired a shot at his son.
SWAT members were requested to the address and surrounded the house as negotiators worked to try to bring the man out peacefully.
Around 10:36 p.m. the man fired one shot from the house, prompting the officers surrounding the house to return fire.
It was not immediately known if the man was hit by gunfire, until police entered the home and found the man was suffering from at least one gunshot wound fired by officers, according to Dayton Police Major Brian Johns.
Johns said the man was transported to an area hospital for treatment but his condition was not released.
The man was conscious when he was found by police, but was also combative with officers as he was taken to the hospital, according to Johns.
The exact condition of the man, how many times he was shot, and his identity were not released by investigators.
Police did not indicate how many shots were fired by officers when they returned fire, nor were any officers who fired shots identified.
Johns said when the initial domestic situation started, multiple family members were inside the home, but all fled the area besides the the suspect when he fired the first shot at his son.
This week, Dayton police have responded multiple times to the same Burbank Drive address. Early Monday morning, officers were first requested for what was described as a mental health call, but cleared the scene without taking anyone into custody.
Dayton police were sent to the address a second time, about 2:42 a.m., after medics were requested to the address for a person with a laceration.
Investigators said at that time the man was believed to have been suffering from a medical emergency and was taken into custody.
Johns said the incidents on Monday and Thursday all appear to be mental health related.
No officers or other family members were injured in the incident.
Additional details are expected to be released Friday morning.
UPDATE @ 11:14 p.m.: We're hearing that the man who was holed up in the house on Burbank Drive is alive and is being removed from the house on a stretcher. His condition is not known.
We’ve also learned that Dayton police were dispatched to the same Burbank Drive address early Monday morning on what was described as a mental health call.
Police were called there at 12:29 a.m. Jan. 23 and a crisis center counselor apparently spoke with the person who was in the house, trying to get the person to come outside.
Police cleared the scene at 1:04 a.m. without taking anyone into custody.
Police were sent to the address a second time, about 2:42 a.m., and this time took a man into custody.
Lt. Mark Ponichtera, who spoke with whio.com at 3 a.m. that day, said the man was believed to have been suffering from a medical emergency.
The man taken into custody early Monday was not identified by name.
UPDATE @ 10:55 p.m.: The man came out of his house, firing a weapon at police, and they returned gunfire, said Sgt. Williams, with Montgomery County Regional Dispatch.
That incident occurred at 10:36 p.m., he said.
No officer was hit but it is not certain whether the man has been wounded.
At 10:47 p.m., the SWAT team breached the front door and went inside to search for the man.
Police also have told us the man fired at his son earlier this evening.
UPDATE @ 8:43 p.m.: A hostage negotiation team is on scene.

FIRST REPORT
Police are positioned outside a residence in the 1900 block of Burbank Drive for a man, believed to be in his 60s, who has been discharging firearms.
Dayton police were dispatched just after 7 p.m. on a shots fired call. A SWAT team has been requested.
The man, who may be suffering from mental health issues, is believed to have a shotgun and a .380 handgun in the house, along with a dog.
He is believed to be by himself, according to a police sergeant on scene.
Police have blocked traffic at Otterbein Avenue and Benson Drive until further notice.
