Smith was sentenced after pleading no contest and being found guilty in November 2015.
Troy police said the investigation began when the mother of a 14-year-old girl came to them about electronic conversations her daughter had with another person. The girl turned to her mother when she grew concerned about the direction of the conversations. A detective continued the conversations with Smith, who later agreed to meet at a Troy park. When Smith arrived, the detective, not a young girl, met him.
Searches of Smith’s phone and other electronic devices led to the charges.
In seeking early release, Smith wrote to Common Pleas Judge Christopher Gee that he was working to better himself and thought daily about his “despicable” actions.
In denying the request, Gee wrote that he had no reason to question Smith’s commitment to change his life. However, the judge wrote, he also had found no evidence in the motion for release to ease his concern about Smith’s behavior escalating from watching child porn to grooming and attempting to meet an underage girl.
“There is no attempt to address the predatory conduct that resulted in his arrest,” Gee wrote.
