Man files lawsuit claiming woman molested, harassed him

CINCINNATI — A former Hamilton resident claims a Fairfield woman stalked, harassed and had a sexual relationship with him when he was a teen dating her daughter.

Matthew Frankey, of Cincinnati, claims in a 14-count civil suit filed Friday, April 30, in Hamilton County Common Pleas Court that he was living with his parents in Hamilton when the mother of his girlfriend, Mary Karen Eyl, “sexually molested,” harassed and stalked him during his high school years.

Frankey’s parents, Ruth and Michael Frankey, of Hamilton, also are plaintiffs in the suit.

The suit details the alleged sexual molestation and harassment, which started when Frankey was 14.

A woman answering the phone number associated with Eyl’s home said it was the wrong number.

According to the lawsuit, the first sexual act happened when Frankey was hospitalized overnight with a hip and leg injury. Since Eyl worked at the same hospital, she allegedly told the nurses on duty there was no need to check on Frankey because she reportedly would care for him.

The sexual conduct continued when Frankey went on family vacations with the Eyl family, the suit alleges.

After Frankey turned 18, according to the suit, he told Eyl multiple times the affair had to end. The suit says that she refused and threatened to commit suicide and blame Frankey.

Frankey eventually refused to continue the affair in the spring of 2009 despite Eyl’s threats.

Beginning in Frankey’s sophomore year of high school, he received “thousands of stalking, harassing, obscene and profane text messages on a constant basis. These messages repeatedly belittled him, claimed that he was worthless and that he did not deserve to be with his girlfriend.”

Frankey also received “hang up” phone calls, as did his parents. Those calls and texts “intensified in frequency and severity” after Frankey and Eyl’s daughter stopped dating.

When Frankey began dating other girls, stalking calls were made or text messages were sent to that girl, her friends or her family. Eventually, the suit claims, Eyl was found with a phone where the calls and text messages originated.

The Frankeys are seeking a judgment greater than the court’s $25,000 jurisdictional amount for compensatory and punitive damages, costs, attorney fees and other relief the court deems appropriate.
