Report: Carlisle police chief shows incompetence, gross neglect of duty

Hearing officer’s report affirms 5 allegations against Chief Tim Boggess.

CARLISLE — Allegations including incompetence and gross neglect of duty against the city’s police chief have been affirmed by a hearing officer.

Three other allegations — dishonesty, failure to obey orders given by the proper authority and nonfeasance — also have been affirmed against Police Chief Tim Boggess, according to a report from a hearing officer.

The report on Boggess, who has been on paid leave since last month over job performance issues, was submitted to City Manager Sherry Callahan on Friday, March 5, by Julie Duffy, the city’s finance director, who presided over the hearing.

Duffy rejected an allegation of malfeasance, but made no ruling on an allegation of failure of good behavior.

Boggess, 44, has been on indefinite paid administrative leave since Feb. 4 for nonperformance issues, according to Callahan.

Carlisle’s city charter states the police chief and other department directors are appointed by the city manager, and the person may be removed — without cause — by the manager.

Under Carlisle’s personnel policies, the city manager is required to carefully review the hearing officer’s report before taking disciplinary action, if any, against an employee.

Boggess has been on the Carlisle force since 1997 and was appointed chief in 2005. He has received disciplinary actions in the past and was warned that additional misconduct could jeopardize his job.

As of Tuesday, no disciplinary action has been taken against Boggess, who has said he won’t resign from his job.

Duffy also affirmed two allegations against Officer Dustin Moore — the officer who missed a Jan. 25 court date in an alleged “road rage” case that involved Mayor Tim Humphries — in a report submitted March 2 to Callahan.

Callahan issued Moore a written reprimand on Monday, March 8. “Due to your failure to appear and give testimony, the city and police department suffered public embarrassment,” Callahan wrote.
