While talking to the driver, identified as Osborne, the deputy noted that he had “red, bloodshot, and glossy’ eyes and that there was “a very strong odor of [an] alcoholic beverage” coming from him, according to the incident report.

Osborne reportedly told the deputy he was coming from the Country Concert and that he was a Montgomery County sheriff’s deputy.
When asked how much he had to drink that night, Osborne said “probably not enough but probably too much,” according to the report.
During a field sobriety evaluation, Osborne was reportedly swaying, had a hard time following the deputy’s finger, lost his balance and almost fell over, the report read.
Osborne also refused to give a breath sample, according to the report.

He was arrested and given a copy of his citation before he and a female passenger were given a ride home because they reportedly did not have anyone who could come get them.
Osborne has been a deputy since 2000 and is currently assigned to the jail transport and court services division of the Montgomery County Sheriff’s Office.
