Marsh, 23, was fatally shot on April 5 in a home on East McCreight Avenue, according to police. A police affidavit says Hypes told them that the two were arguing when a shoving match began. He brandished the firearm but didn’t intend to kill Marsh, Hypes said, according to the affidavit.
“During the shoving, Travis said he reached into his right pocket and pulled out a pistol,” the affidavit says. “She shoved him again after the gun, so he shoved her back with both hands His right hand had the gun in it, and as he shoved her, it discharged.”
Marsh’s family disputes the claims, saying that Marsh was protective of her baby and adding she would never willingly get into a shoving match.
Hypes has been charged with two other felonies since he’s been locked up. One of the charges stems from a disagreement he had with jail officials when he was asked to move pictures of Marsh from a jail window, according to an affidavit.

“He stood up and began to yell … that no one was going to touch” the photos, the affidavit says. “He was told once again our only objective was to be able to see that the integrity window is not compromised. To this, Inmate Hypes reacted by spitting on (a jailer).”
Hypes is being defended by the Clark County Public Defender’s Office. The office was closed Monday, which was Columbus Day.
