Dayton teen shot by police after Miamisburg crime found competent to stand trial

UPDATE @ 11 a.m.:

A judge ruled a teen accused of holding up a gas station and exchanging gunfire with an off-duty police officer competent for trial.

Judge Barbara Gorman scheduled Charles Ashford’s trial for June 3.

His final pretrial hearing is scheduled for next week.

INITIAL REPORT:

A finding is expected Wednesday on the competency of a Dayton teen facing multiple charges after a 2018 Miamisburg armed robbery authorities said he was fleeing before being wounded by police.

The ruling on Charles Vincent Ashford’s status will come after a second evaluation was sought by his defense attorney, Jeffrey Gramza, who earlier entered a not guilty by reason of insanity plea for his client.

Gramza sought the second exam after an initial one determined the 19-year-old competent for trial as an adult for crimes that Ashford was accused of when he was 17, according to Montgomery County Common Pleas Court Judge Barbara Gorman’s court.

Neither report on the defendant has been made public, but both are expected to be after the judge’s ruling, court officials said.

Ashford was shot Feb. 5, 2018, by an off-duty Miami Twp. police officer after authorities said he was fleeing an armed robbery of a Miamisburg Shell Station. Authorities described the incident as a chaotic, life-threatening scene that drew several law enforcement agencies to the Ohio 725/Interstate 75 interchange.

Court records show Ashford fired a gun at police and claimed to be an undercover FBI agent.

The insanity plea was entered in January about two weeks before Ashford was set for trial.

The charges against him include seven counts of aggravated robbery, one count of felonious assault on a police officer, discharge of a firearm on or near prohibited premises, and impersonating a peace officer, records show.
