The jury found Lacey guilty on three counts: Rape of a child younger than 13, gross sexual imposition and importuning.
Lacey was arrested in February after the victim, who was 12 years old at the time and is known to the defendant, went to Fairborn police and filed a report.

Prosecutors presented evidence that the victim was staying at Lacey's home on Redbank Drive for about a week in December and, at the end of that week, the defendant made her smoke marijuana and engage in sexual conduct with him.
According to the statement of facts on file with the court, investigators monitored a "control call" in which the victim told Lacey that she was thinking of telling her school counselor what happened. The defendant told her in the phone call not to talk about it, and that he "was high" and didn't mean for it to happen, according to the statement of facts.
