Dr. Wine was facing two counts each of rape, and sexual battery and gross sexual imposition allegedly against a child under the age of 13.
In late October of 2011 a jury in Auglaize County Common Pleas Court in Wapakoneta found Wine not guilty of rape as charged, but guilty of a lesser offense of gross sexual imposition of a woman, then age 69, when the offense happened in 2009 in his rural home.
If additional evidence in this second case would surface the proecutor has the right to bring back the charges.
In the meantime Wine is appealing his conviction in the first case.
