Sentence Handed Down In Greene Co. Sex Sting Case

A New Lebanon man is headed to prison for trying to meet a teenage girl for sex in Greene County. Now, he has been charged with the same crime in Darke County.

Kevin Westerbeck is one of 17 men who were arrested last Friday during a sex sting in Greenville organized by Darke County prosecutors and a national news agency.

Police in Fairborn arrested Westerbeck in August for allegedly trying to meet a 14-year-old girl for sex. He was in court last Friday on that charge and pleaded guilty to it.

Prosecutors said half an hour after he entered his plea, he was back on the computer and on his way to Greenville, where he was arrested again.

On Thursday, he was in court and sentenced for what happened in August.

Westerbeck said in court that he had no comment and was immediately sentenced to 11 months in prison. He was sentenced in connection with using his computer to solicit sex from whom he thought was a teenage girl, and then traveling to Fairborn to meet her.

There was then discussion on whether he should be labeled a sexually oriented offender or a sexual predator. Prosecutors said, in light of Westerbeck's recent arrest in Darke County, the choice should be obvious.

The defense attorney said, “The classification of sexual predator versus sexually oriented offender has a significant impact on Mr. Westerbeck.”

The court ruled that Westerbeck should be labeled a sexual predator. While the defense attorney was not happy with the judge’s ruling, prosecutors were pleased.

Westerbeck is now headed to prison for the crime in committed in Greene County. He is expected back in the Miami Valley soon to face the charges against him in Greenville.
