2nd person convicted in 2012 killing of Dayton dad

A 22-year-old man is the second person to be convicted in the May 2012 slaying of a Dayton father of three.

Mitchell D. Gray Jr. was found guilty Friday by a Montgomery County Common Pleas jury on charges of murder, aggravated burglary, aggravated robbery and kidnapping.

He faces a sentence of up to 40 years for killing Robert Munday, 34, who was shot May 21, 2012, in the backyard of a home on Genesee Avenue in what police described as a robbery attempt.

Co-defendant Linda Rocia Kay, 24, was sentenced in January 2013 to life in prison after she was convicted of murder and other charges in Munday's slaying.

Kay, also known as L.K., is in the Dayton Correctional Institution.

On the night of the slaying, neighbors told police they heard yelling and gunfire. Police said Munday had just returned his children to their mother after having them for the weekend.

Gray was wounded in the exchange of gunfire and treated at a hospital before he was taken into custody on unrelated warrants.

Kay was indicted the month after killing. A grand jury indicted Gray on the same charges in December 2012.

Munday's children, two girls and a boy, now range in age from 12 to 15 years old.

A separate case is pending against Gray on charges unrelated to the Munday slaying, according to the prosecutor's office, and he is expected to be sentenced after that case is concluded.
