According to an affidavit filed in Municipal Court, Albers has admitted that he engaged in sexual activity with a 16-year-old girl.
Albers was employed by the Orthopaedic Center for Spinal and Pediatric Care, which has offices at several area hospitals. He is no longer seeing patients at the center, according to the website for the practice.
According to a statement released earlier this year by the center, Albers is suspended from the practice and “none of these charges involve Dr. Albers’ role as a physician caring for patients.”
The center has offices at Children’s Medical Center, Miami Valley Hospital South, Stanfield Place in Troy and Atrium Medical Center in Middletown.
According to the police investigation, the girl at the center of the criminal case was not a patient, a point stressed by Albers’ attorney, Thomas Kollin He noted that Albers “definitely” will plead not guilty to all counts.
“My understanding at this point is there’s no physical evidence,” Kollin said. “It’s just simply a he-said, she-said type case.”
Kollin discussed a plea agreement with prosecutors in the past few months, a process which delayed the case coming before a grand jury.
Suzanne Schmidt, Greene County first assistant prosecutor, said the case was presented to a grand jury Sept. 22. A secret indictment was filed against Albers two days later, according to court records.
Albers, a former resident of the River Ridge II development of Sugarcreek Twp., now has an address of 9609 Iris Drive in Cincinnati, according to court records. Albers is also in the midst of a divorce brought by his wife, Cynthia.
“When his private family life is exposed, it’s sad, and it’s a no-win situation for Dr. Albers,” Kollin said. “But he has no other alternatives or choices.”
Greene County Prosecutor Stephen K. Haller said investigators interviewed other children who had contact with Albers and found no evidence that any of them were assaulted.
“We don’t have any reason to believe there are any other victims out there,” Haller said earlier this year.
According to the indictment, the incidents alleged occurred between Jan. 1 and June 15,.
Sugarcreek Twp. police Sgt. Mark White said he and an investigating officer arrested Albers on June 20 at his residence in the township after a complaint was phoned in by the girl’s mother and an interview with the girl. Albers posted bond two days later and was released, according to court records.
