Celina settles with family in fatal police shooting

The city of Celina has settled a wrongful death lawsuit with the family of Robert Hensley, who was fatally shot by a former Celina police officer in April 2013.

The Hensley family received $800,000 in exchange for dropping the suit and neither the city nor the officer, former patrolman Andy Regedanz, admits liability, according to a release from the law office of Gerhardstein & Branch Co., who represented the Hensleys in the case.

Regedanz confronted Hensley in the parking lot of Lake Shore Motor Sales. The officer was responding to the report of a man walking along Market Street and displaying a handgun.

Regedanz shot Hensley, who later died at the hospital. The incident was investigated by the Mercer County Sheriff’s Office and a special prosecutor presented the case to a grand jury, which chose not to indict the officer.

New Celina Police Chief Tom Wale has implemented changes in the department’s policy regarding the use of force and the department is in the process of buying cruiser and body cameras, according to the release.

Wale said in a prepared statement: “As a police department, we are committed to serving the public and keeping the city of Celina safe. Like any organization, we always have room to improve. We believe the city of Celina will be better for it.”

One of the family’s attorneys, Al Gerhardstein, said in a prepared statement: “I commend the city of Celina for responding to the family with sensitivity and transparency. Our settlement and the reforms underway are good both for the family and the city of Celina.”
