Ex-Fairborn police officer accused of stalking

UPDATE @ 7 p.m.: Former Fairborn police Officer Mark Miller is charged with two misdemeanor counts as the result of a department investigation triggered by a stalking complaint.

Miller, 52, a nine-year veteran with the department, was charged Thursday with two counts of attempted unauthorized use of a computer or telecommunications property. He is to be arraigned in city Municipal Court on Monday.

"During the course of the criminal investigation, it was determined that the actions of Mark Miller rose to the level of criminal misconduct," Police Chief Terry Barlow said in a written statement. "After the conclusion of the criminal investigation, the case file was presented to the Greene County Prosecutor's Office for review of warranted criminal charges."

Barlow did not provide details of the charges. A copy of a protection order revealed that Miller was accused of leaving letters and gifts at a woman's home.

The woman, who asked not to be identified for her safety, wrote in the order that he "shows up to my home to leave letters, gifts, etc. while he is on duty and off."

She said, "It's intimidating to be stalked by anyone, but it's even more so intimidating when it's a police officer. I don't know if at any given time if I'm going to walk outside and something's going to happen."

Miller was said not to be available Friday for comment, according to a woman who answered the door at his residence.

The police department disciplined Miller three times, according to a review of his personnel records:

  • In April, he was dispatched to a suicidal subject and took the victim in his cruiser to Miami Valley Hospital without handcuffs, which is a violation of department policy.
  • In a January 2005 injury crash while on duty, he was not wearing a seat belt. He was disciplined for that as well.
  • In 2010, he was accused of an improper turn without exercising due care while attempting to stop a driver for a traffic violation.

FIRST REPORT: A former Fairborn police officer is facing criminal charges following an investigation.

According to Fairborn police, a Civil Anti Stalking Protection Order was ordered in May on Mark Miller, a Fairborn Police officer. Miller was placed on administrative leave, and the police department conducted an internal and criminal investigation.

Miller resigned from his position on June 24. The criminal investigation determined that Miller's actions rose to the level of criminal misconduct, and the case was presented to the Greene County Prosecutor. Miller is facing two counts of attempted unauthorized use of computer, cable or telecommunications property, according to the release.
