Judge sends Troy bank robber to prison

A Troy man who pleaded guilty to felony robbery and misdemeanor making a false alarm was sentenced Monday in a Miami County Court to 30 months in prison.

Judge Jeannine Pratt rejected a joint recommendation from prosecutors and the defense for an 18-month sentence for Brian Feltner, 40.

Pratt said Feltner had a long criminal record, including previous time spent in both jail and prison, and showed no remorse for his actions. She said she couldn’t “in good conscience” follow the jointly recommended shorter sentence.

Defense lawyer John Herndon objected to the sentence, asking the judge to allow Feltner to withdraw his pleas and to take the case to trial. Pratt said it was too late in the process to allow the plea withdrawal.

An appeal for Feltner can be filed with Ohio’s 2nd District Court of Appeals.

Troy police said Feltner called 9-1-1 before the robbery Feb. 18, saying someone had a gun at Walmart in Troy. Several minutes later, he robbed the Main Source Bank on the other side of town and then left on foot. A gun was not shown during the robbery, police said.

Feltner also was sentenced to $4,883 restitution.

A Troy man has pleaded guilty to felony robbery and misdemeanor charges for making a false alarm in a Feb. 18 holdup of the Main Source Bank on South Market Street in Troy.

Brian J. Feltner, 40, made the pleas July 9 in Miami County Common Pleas Court. He was accused of calling 9-1-1 before the robbery, saying someone had a gun at Walmart in Troy. Several minutes later, he robbed the bank on the other side of town and then left on foot. No weapon was seen and no one was injured, Troy police said.

Feltner will be sentenced Aug. 10.

According to the plea document filed in court, restitution of $4,883 will be a part of the sentence.
