Man accused of sexual assault of minor at rodeo

LEBANON — A Clearcreek Twp. man charged with unlawful sexual conduct with a 13-year-old Franklin girl was freed today on $20,000 bond.

Gavin E. Smith, 20, is accused of sexually assaulting the girl in the parking lot of the Fox Hollow Stables on Ohio 73 during a recent rodeo, police said.

Officers questioned Smith after the girl’s parents reported the incident, Clearcreek Twp. Police Chief John Terrill said.

Smith, who could not be reached for comment, told police the sex was consensual, Terrill said.

However their age difference exceeds the four-year minimum required by Ohio law in sexual assault cases involving victims 13 to 16 years old, according to Gary Loxley, an assistant prosecutor and spokesman for the Warren County Prosecutor’s Office.

Smith was released today from the Warren County Jail after posting bond. He is barred from contacting his alleged victim and other minors. He is scheduled for a preliminary hearing March 15 in Warren County Court.
