Man charged with child sex abuse 7 years ago released from Warren jail

A Franklin man facing rape and gross sexual imposition charges involving a 4-year-old boy more than seven years ago has been released on his own recognizance.

Judge Donald Oda II reduced the bond for Jerry Hurst, 58, during a hearing on Tuesday in Warren County Common Pleas Court.

Hurst is accused of engaging in sexual conduct and contact with a minor younger than 10 years old between January 2010 and July 2011, according to the indictment.

Barry Spaeth, a lawyer appointed to represent Hurst, pointed out the allegations were seven years old and that Hurst had medical and psychological needs he could better attend to outside the Warren County Jail.

“He needs to be at home,” Spaeth said during a hearing Tuesday.

Oda ordered Hurst, on probation for drug trafficking, be placed on electronic monitoring and warned him to avoid contact with the alleged victim or face being sent to prison on a probation violation.
