Man faces 5th drunk driving arrest

A Clayton man was arrested this weekend for his fifth drunk driving charge.

Police stopped Gary Herr, 59, on Saturday after he turned in front of a vehicle at Allison Avenue and Barrington Drive. Herr allegedly told the officer "you got me," and said he was on his way to buy more beer at a North Main gas station, according to a police report.

He refused to take any sobriety tests, according to the report.

Clayton police said they found Herr has four prior convictions for operating a vehicle impaired in 1982, 1995, 2000 and 2003.

He was taken into police custody just before 4 p.m. and remains in Montgomery County Jail as of Monday.

He was charged with misdemeanor OVI and prior OVI within 20, according to jail records.
