Viral beating video ‘not our guy,’ county prosecutor’s office says

“After having the prosecutor look at the video, that is not our guy,” office spokesman Greg Flannagan said.

Greg Horn, 35, of Dayton, has been indicted on two counts of child endangerment by corporal punishment — one a second-degree felony and one a third-degree felony against girls aged 12 and 14 years old. Flannagan said case notes indicated Horn allegedly beat the girls for sneaking out of the house. The incident was to have happened Oct. 28, 2012.

The video and associated news stories have circulated online in various forms, with some articles urging calls to the prosecutor’s office. That prompted a call to the prosecutor’s office from a news agency in Los Angeles. “It kind of made our life miserable today,” Flannagan said.

Horn is listed as 5-foot-9 inches and 230 pounds and Flannagan said the male in the video appears leaner, if not taller and leaner than Horn, who is scheduled to appear in court April 16. A warrant to arrest Horn has been issued.

Flannagan said the assistant prosecutor who is handling the case watched the video. “She said what’s going on in this video does not fit the facts of the case as it was relayed by the victims,” Flannagan said.
