UPDATE: Charge dismissed against mom in Miamisburg Amber Alert case

A mother accused of taking her 2-year-old son in a case that prompted an Amber Alert has had that charge dropped.

The interfering with custody case against Kelsey Hannah — in connection with an August incident involving Atticus Phillips — was dismissed this afternoon in Miamisburg Municipal Court Judge Robert Rettich’s court, records show.

Hannah, 30, who has a Miamisburg address, pleaded not guilty in that case. She was scheduled for the a pre-trial hearing today, when the charges were dismissed, court records show.

An arrest warrant was issued for Hannah Aug. 15 after authorities said she took the boy in defiance of a Warren County court order.

Hannah returned her son that day and had been summoned to appear in court.

Hannah has no criminal history except for some minor traffic violations, court records show.

At the time of the incident, Miamisburg Sgt. Jeff Muncy said, the Amber Alert, an Endangered Missing Child Advisory and social media put pressure on Hannah to return. She met with an attorney and made arrangements to come in, he said.

The case escalated after Hannah did not turn custody over to Phillips’ uncle on Aug. 13.

On Aug. 14, the Warren County judge issued stronger language. The judge ordered her to turn over her child. Muncy said he did not get the case until Wednesday and that no one had been able to reach Hannah.

The failed attempts to contact Hannah and the language in the court order indicating the child was “at risk” in his mother’s care prompted the Amber Alert, Muncy said at that time.
