Kimpel has been under the microscope for over a year since Deputy Jodi Van Fossen claimed he sexually assaulted her in July, 2010. Van Fossen said she was under the influence of prescription drugs and alcohol when Kimpel came to her house and had sex with her after she passed out.
Kimpel denies any contact with Van Fossen. Van Fossen filed a criminal complaint against Kimpel in January.
In February, about a dozen residents of Shelby County called for Kimpel's resignation. Members of a group called "Citizens for Accountability, crowded the Shelby County Commission meeting and asked commissioners to sign a petition to recall Kimpel. Commissioners refused to sign the petition and said they were going to wait on the legal system to handle the issue.
