No charges for off-duty West Milton officer who struck, killed woman

UPDATE @ 4:45 a.m. (Dec. 7)

A Miami County Municipal Court Prosecutor declined to file charges against West Milton Police officer Jason Stevens for his role in a fatal pedestrian strike on November 6th on South Miami Street.

State troopers said evidence collected at the scene indicates the victim, 45-year-old Tina Miller, of West Milton was at fault, and there was nothing Stevens could do to avoid striking Miller.

Stevens was off-duty and heading home following his shift when the crash occurred.

Stevens has been on paid administrative leave since the crash. It was not immediately known if Stevens has been allowed to return to work.

Jason Stevens, the off-duty West Milton police officer who struck and killed a woman and her dog Sunday night, is on administrative leave, pending the results of the Ohio State Highway Patrol investigation, West Milton Police Chief Harry Busse said Monday morning.

Busse said Stevens got off work at 7 p.m. and was traveling south on South Miami Street when he hit Tina Miller, who was walking her dog across the 1000 block. Busse said the victim resided no more than half a mile from where she was struck.

There is no crosswalk in that area, and investigators said last night it is a poorly-lit area. Busse said Stevens said he didn’t see Miller.

Busse also said there are street lights in that vicinity, “but it doesn’t take the place of daylight.”

“Headlights illuminate some things, but it’s not bright daylight,” Busse said. “There’s light, but it’s not really bright.”

The crash remains under investigation by the Ohio State Highway Patrol.

“It’s a tragedy,” Busse said. “It’s a traffic accident nobody wanted to see happen. I really feel for the victim’s family, and the officer and his family.”

State troopers have identified the woman and off-duty West Milton officer who were involved in a fatal pedestrian crash Sunday night.

45-year-old Tina Miller of West Milton and her dog were hit and killed attempting to cross South Miami Street just south of Tracie Road in West Milton, the Dayton Post of the Ohio State Highway Patrol said in a release.

The driver, 38-year-old Jason Stevens, of Huber Heights, who was previously identified as an off-duty West Milton police officer, just finished his shift and was headed home at the time of the crash.

Troopers said Stevens was not injured in the crash and attempted to administer first aid to Miller until other units arrived.

Troopers said a preliminary investigation found that Stevens was traveling south on South Miami Street when he struck and killed Miller, who was attempting to cross the street.

Investigators at the scene said Miller was not in a crosswalk and was in a poorly lit area.

UPDATE @ 9:30 p.m. (Nov. 6)

An off-duty West Milton police officer struck and killed a woman tonight as she was walking her dog across South Miami Street.

The woman and her dog were both killed at the scene in the 1000 block of South Miami Street, West Milton police said.

The officer had just finished his shift and was headed home at the time of the accident. The woman was not in a crosswalk, and the area is not lit, police said.

The crash is under investigation by the Ohio State Highway Patrol.

The names of the officer and woman have not been released.

Crews were called tonight to a serious crash involving a pedestrian.

The crash was called sometime around 7:40 p.m. in the 1000 block of South Miami Street.
