Nicholas and his children were visiting Florida when the incident occurred. The Associated Press reports the children told deputies they jumped out while he was driving “relatively slow” because they were afraid, according to court documents.
The children walked to a neighbor’s house where they called for help. The charging affidavit states that Nicholas never went back to get them, according to the Associated Press.
He showed up hours later and was arrested on scene.
Nicholas is the owner of the Orr Felt Company on South Main Street in Piqua, according to the company’s website. The company has a 300,000 square foot facility in Piqua.
According to local court records, Nicholas was charged with a DUI in Piqua in 1999 and convicted of a lesser charge of willful or wanton disregard of safety for which he was on probation until 2000. He was convicted of the same charge in 2001.
He was convicted of driving under the influence of alcohol in Miami County in April of 2008 and granted limited driving privileges in November of that year, according to court records.
