Montgomery County Common Pleas Judge Mary Katherine Huffman set Brandt’s sentencing for February 26, stating that this should allow time for Brandt to meet the conditions of his plea agreements.
Brandt’s plea agreement in Miami County stipulates that Brandt will testify in the Jan. 8 trial of Jason Zwick, 30, of Beavercreek. Zwick is accused of three counts of rape against one of Brandt’s sons after Zwick allegedly answered Brandt’s Craigslist ad for taboo sex. Montgomery County Prosecutor Mathias H. Heck, Jr. said Brandt will also testify against a third man in the case, Patrick Rieder.
Brandt,who was caught by an Internet crimes task force, originally faced 31 felony rape counts in Miami County and seven rape or complicity to commit rape counts in Montgomery County. Of the Miami County charges, 25 were dismissed in the deal along with a specification that one of the three victims was under age 10.
Each of the six counts of rape drew 10-years-to life sentences to be served consecutively. Brandt also was labeled a Tier III sex offender, which means he would have to register with the Sheriff’s office every 90 days in the unlikely event he ever gets released.
According to investigators, Brandt took one of his son’s to Rieder’s apartment in Dayton so that Rieder could have sex with him. Coincidently, Rieder’s trial in an unrelated robbery case started Thursday in the same courtroom. Rieder’s trial concerning sex charges against Brandt’s son was set for Feb. 19.
Brandt, Zwick and Rieder, 32, of Dayton were indicted in the spring as part of an investigation by the Ohio Internet Crimes Against Children Task Force. Rieder was indicted on charges of sexual activity with one boy in Montgomery County.
