Today in court, Huber Heights Police Chief Mark Lightner testified about past incidents at the bar.

There have been 209 total calls for service at Kricket’s Tavern from Jan. 1, 2014 to Sept. 28, 2015, the court was told.

Of those, 68 were investigated as potential crimes. Twenty-seven incident reports have been generated, including possession of marijuana, disorderly conduct, public intoxication, obstruction of justice, resisting arrest, assault, rape, underage serving and murder.

Huber Heights is being represented by Mike Bly, a member of the city’s legal counsel.

Attorney Jeffrey Slyman is representing the defendants.

UPDATE @ 11:04 a.m. (Oct. 19)

A preliminary injunction hearing on the fate of Kricket’s Tavern is underway in Judge Mary Wiseman’s courtroom in Montgomery County Common Pleas Court.

The hearing started at 10:30 a.m. today.

At the end of September, Judge Wiseman issued a temporary restraining order against the Huber Heights bar where a 19-year-old was shot and killed.

Last week in the murder case, Michael Scott was arraigned in Judge Steven Dankof’s courtroom in Montgomery County Common Pleas Court. His bond was set at $1 million.

The next hearings in this criminal case will be a status hearing for the attorneys only on Oct. 21. Then Michael Scott will be back in Judge Dennis Adkins courtroom at 2 pm Oct. 28 for a scheduling hearing.

UPDATE @ 3:21 p.m. (Oct. 9)

A Montgomery County grand jury indicted Michael D. Scott, 20, on two counts of murder; two counts felonious assault; and single counts of having weapons under disability and illegal possession of firearm in liquor permit premises.

The charges are in connection with the shooting death of 19-year-old Joshua Hamilton inside Kricket’s Tavern in Huber Heights.

He will be arraigned Oct. 15 in Montgomery County Common Pleas Court.

UPDATE @ 11:36 a.m. (Oct. 5)

Scott was arraigned in Montgomery County Common Pleas Court this morning, and bond was set at $1 million. He also pleaded not guilty.

UPDATE @ 7:40 p.m. (Oct. 2): A suspect wanted in the shooting death of a Springfield man inside a Huber Heights bar turned himself in this evening to the Montgomery County Jail.

Michael Daren Scott, 20, was wanted in connection to the death of 19-year-old Joshua Hamilton, who was killed early Sunday inside Kricket’s Tavern in the 5400 block of Brandt Pike.

Scott arrived at the jail around 7:20 p.m. and was booked in lieu of a $1 million bond on two counts of murder, two counts of felonious assault, and two felony weapons violations. He is scheduled to appear Monday in court, online jail records show.

UPDATE @ 9:37 a.m. (Oct. 1)

Michael Daren Scott is described as being approximately 6-foot-1 and weighing approximately 170 pounds. He has black hair, which was in braids at the time of the shooting, police said. He also has numerous tattoos on his arms, neck and chest.

UPDATE @ 9:27 a.m. (Oct. 1):

The Montgomery County Prosecutor’s Office has approved charges for Michael Daren Scott, the suspect in Sunday’s shooting at Kricket’s Tavern on Brandt Pike.

Police are still searching for Scott and he should be considered armed and dangerous.

Scott, 20, was charged with two counts of murder, two counts of felonious assault, one count of weapons under disability and one count of illegal possession of a firearm in a liquor establishment, police said in a statement.

UPDATE@4:26 p.m. (Sept. 30):

A Montgomery County Common Pleas Court judge issued a temporary restraining order against a Huber Heights bar where a 19-year-old was shot and killed this past weekend.

Judge Mary Wiseman granted the city of Huber Heights’ request Wednesday afternoon for a temporary restraining order against Kricket’s Tavern on Brandt Pike.

The bar has been ordered to close until a hearing set for 9 a.m. Oct. 13.

Kricket’s Tavern had planned to host a benefit on Wednesday for the family to help pay for funeral expenses. But the benefit had to be canceled due to the court’s order.

A 19-year-old Springfield man was fatally shot early Sunday inside a Huber Heights bar that has had multiple state liquor control violations for selling alcohol to minors.

Huber Heights police found Joshua Hamilton deceased inside Kricket’s Tavern when they arrived.

Police believe an altercation occurred inside the business that has a glass door with wording that states patrons must be 21 to enter the establishment.

Hamilton, who has a 6-month-old daughter Avey’Onnia, was out celebrating his sister’s birthday, according to his family.

“Everything was fine, and we left, and they called and said to come back, he was gone,” his mother, Kathy Hamilton, said Sunday evening. “He was so happy to walk in there and see our faces because we didn’t know he was coming.

“All Josh wanted to do was celebrate his sister’s birthday with her,” she said. “He’d do anything for any of us.”

Joshua Hamilton was known as “Buggy” and had four siblings. His live-in girlfriend and mother of his daughter, Starletta Palmer, was devastated along with his family.

“He was a good person, he was bubbly, had a great personality,” said Palmer, who has been with Joshua Hamilton for two years. “I asked him not to go, but I mean, he went to celebrate it with his sister.

“My baby can’t wake up and see her daddy,” she added. “I just love him so much and I wish he was here.”

Friends and family held a candlelight vigil in his memory Sunday evening in Springfield.

Officers were dispatched to the 5400 block of Brandt Pike around 2:30 a.m. Sunday in response to a silent robbery alarm.

“While crews were en route, they started receiving multiple 9-1-1 calls reporting shots fired,” said Lt. Tony Ashley of the Huber Heights Police Division.

Hamilton’s preliminary cause of death is due to a gunshot wound, according to the Montgomery County Coroner’s Office.

Kricket’s Tavern was one of six businesses cited by Huber Heights police last year for selling alcohol to a minor.

Kricket’s Tavern owner Dandt Amusements LLC has also had multiple liquor permit violations filed with the Ohio Division of Liquor Control this year, according to the state liquor control website. These violations include sale and/or furnishing to a person under 21, electronic video and game of chance gambling, sales to intoxicated persons, allowing drunkenness on the premises and improper conduct-illegal possession of electronic benefit transfer.

Kathy Hamilton made an appeal to whoever did the shooting.

“Turn yourselves in, so my baby got justice,” she said. “You all didn’t have to do him like that. He’d have done anything in the world for any of them.”
